Arias, Fábrega & Fábrega successfully filed an opposition suit against Autopiezas Casa Japon, S.A. and its trademark application AMG y Diseño based upon the following arguments: 

1. Daimler AG argued its prior rights over its trademark “AMG y Diseño” in countries members of the General Inter-American Convention for Trademark and Commercial Protection as well as upon the Paris Convention.
2. ARIFA conclusively proved that Daimler AG registered its “AMG y Diseño” trademark before the date of filing of the Panamanian application AMG y Diseño. Therefore, the Judge ruled in our favor based upon the rights provided by Article 6 quinquies of the Paris Convention (Law No. 41 of July 13, 1995) as well as Article 3 of the General Inter-American Convention for Trademark and Commercial Protection.
