Arias, Fábrega & Fábrega successfully filed an opposition suit against Laboratorios Bonsante de Latinoamerica Corp. and its trademark applications Bonsante, Nos.204519-01 y 204520-01, in classes 05 and 10, based upon the following arguments:

a) The prior use, registration and notoriety of the trademark La Santé, and its other trademarks, Laboratorios La Santé y Diseño, Laboratorios La Santé Elter, and La Santé Genéricos y Diseño in the commerce.
b) The affiliation or relationship between the International Classes 05 and 10.
c) The registration of the trademark Bonsante will induce the public consumer to errors, mistakes or deception as to the quality, nature and origin of the products.
d) The similarity of Bonsante to the Commercial Name or Trade name of Laboratorios La Santé S.A.

The Trademark Bonsante, Nos.204519-01 y 204520-01, was denied by the Judge.
