Arias, Fábrega & Fábrega successfully filed an opposition suit against Costa Brava Internacional, S.A., and its trademark application for “Frocs y Diseño”, No.210933-01, based upon the following arguments:

a) The prior use, registration and notoriety of the trademarks “Crocs” and “Diseño”, in the name of Crocs, Inc.
b) The similarity of the concept of the device of a frog compared to the crocodile own by Crocs, Inc.

The Trademark “Frocs y Diseño” was denied by the Judge.
