Arias, Fábrega & Fábrega successfully filed an opposition suit against Kokoa del Istmo, S.A., and its trademark application Chocoquick y Diseño based upon the following arguments: 

1. The prior use, registration and notoriety of the trademarks Quik, Nesquik, Nesquik y Diseño and Nestle Quik over the trademark Chocoquick y Diseño, in the national as well as in the international commerce, and,
2. The similarity of the trademark Chocoquick y Diseño with the trademarks Quik, Nesquik, Nesquik y Diseño and Nestle Quik over the trademark Chocoquick y Diseño.

Therefore, the registration of the trademark Chocoquick y Diseño, would have infringed the Panamanian Law, and Article 6 quinquies of the Paris Convention (Law No. 41 of July 13, 1995) as well as Article 3 of the General Inter-American Convention for Trademark and Commercial Protection.
