Arias, Fábrega & Fábrega filed an opposition suit against the trademark "Dell y Diseño", in the name of the local concern Dell Office, S.A. 

This opposition suit was successfully decided in favor of Dell, Inc., based upon

1. the notoriety and prior rights of the mark Dell, in the international as well as in the national commerce; and
2. the visual, graphic and phonetic similarity between both trademarks. 

Furthermore, the Sentence of the Judge issued a special paragraph regarding the importance to protect the rights of the public consumer and the source of origin of the well-known trademark Dell.
