Cease and desist letter to Banvivienda against using the trademark BRASIL 2014™
Arias, Fábrega & Fábrega represented Fédération Internationale de Football Association (FIFA) in a suit against Panamanian bank Banvivienda when the sports agency became aware of a ticket promotion named "Cuenta de Ahorro Mundialista" that Banvivienda was offering to its clients. This promotion was unlawfully using the trademark "BRASIL 2014™" and offered a ticket to the 2014 World Cup tournament in Brazil.
ARIFA argued that Banvivenda would derive an economical benefit from such a promotion without having any connection to the tournament. This would be detrimental to FIFA's official commercials partners, sponsors and national supporters, such as VISA and Bank ITAU.
ARIFA successfully represented FIFA's claim. This led ARIFA to meet with the Panamanian authority in charge of commercial promotions - Junta de Control de Juegos. The authority now checks with ARIFA about all promotional filings for commercial ventures that do not appear to have FIFA approval.
