ARIFA successfully defends Azucarera Nacional's interests and settles a US$2 million dollar claim for damages
Arias, Fábrega & Fábrega represented the interests of Azucarera Nacional, S.A. in a civil claim for damages filed by an evicted shrimp farmer who had benefited from a criminal conviction issued against certain employees of the sugar cane producer.
The employees had eliminated a shrimp pool built in Azucarera's premises without authorization. The criminal conviction issued against Azucarera's employees for eliminating the shrimp pool gave claimant a right to demand mandatory indemnification for damages against the employer, allegedly represented by the loss of shrimp production and profits that could have derived from such business activity.
After Azucarera filed a counterclaim supported by hard evidence, the claimant settled for less than 5% of the original US$2 million claim. ARIFA recommended the settlement in an effort to contain costs for the client, as litigation fees and expenses required for expert testimonies and inspections involved in the litigation were of consideration. It was ARIFA's initiative to file the counterclaim for damages caused by the shrimp farmer due to the unauthorized construction of the shrimp pools or tanks on Azucarera's property, affecting the production of sugar canes due to the flooding of the area, that forced the claimant to reconsider his position.
