ARIAS FABREGA & FABREGA acted as counsel to Orphee in a case concerning counterfeited products of the trademark Orphee, which were imported to Panama, by the Panamanian corporation Josmar & Asociados, S.A. 

Due to the negative consequences of this commercialization, which involved not only the health of the public consumers, but the prestige and the sales of Orphee in the country, the firm advised the client to initiate the case by sending a strong cease and desist letter to the Panamanian corporation.

Consequently, as expected, Josmar Y Asociados S.A. put the counterfeited merchandise at our disposition, and signed an undertaking letter stating their "unconditional position not to import nor use or trade, under no circumstance, as of this date, any product under Orphee trademark, and that from now on, they will import, use and trade reagents under a trademark other than Orphee to be used in any equipment, including Mythic". 

The litigious merchandise was destroyed.  Kindly note that the client was very pleased with the results of this matter and for avoidance of the inconveniences and the uncertain results of an infringement action.
