Arias, Fábrega & Fábrega represented Christian Casey LLC in opposition actions filed by the Panamanian corporations Made in U.S.A., S.A. and Parfums El Magnate, S.A. against its trademark Unforgivable Sean John.

The trademark Unforgivable Sean John was subject to opposition suits based upon the prior existence of the trademark Forgivable. 

This case was  important due to the fact that besides the opposition suits, our client could have been subject of an infringement action, given the fact that the merchandise had been commercialized to the Latin American countries through the Colon Free Trade Zone of Panama. Nonetheless, after two years of negotiations with counterparts, a coexistence agreement, which solved the problem, has been subscribed.
