Arias, Fábrega & Fábrega acted as counsel to Fronsac Investment S.A., Upcoming TM S.A. and Fronsac TM S.A. in connection with opposition actions filed against the trademarks Sixty Eight and design and 69-Sixty Nine and design in the name of Mahadev Import & Export,  S.A. and  Inversiones Pocahontas, S.A., respectively. 

This case was important because even thought the trademarks Sixty and Miss Sixty, of the Sixty Group, are not used in the Republic of Panama, the Panamanian Courts recognized the prior use thereof worldwide.  Consequently, we can attest that the Panamanian law recognizes the international use of a mark, as long as evidence thereof is provided to the Judicial Courts.
