Sea Debt Management Panama, S.A. vs Sichem Edingburg

The matter involved the arrest of the vessel Sichem Edinburgh owned by a subsidiary of the Team Tanker's Group. The plaintiff was assignee in rights from a company from the OW Bunkers group. At such point it became relevant to ascertain the rights that Sea Debt Management Panama, S.A. could have as to seek a settlement arrangement, vis a vis, the well-known bankruptcy situation of the OW Bunker Group. 

In this case the subsidiary assigning rights was a Panamanian corporation which was not in dissolution, thus subject to certain terms negotiated, the settlement when through to the client's full satisfaction.

The matter would have also involved certain issues as to the settlement amount not being in detriment of the foreign bankruptcy proceedings.

The termination of the proceedings was made through unilateral withdrawal by plaintiffs.
